Acceptable Use Policy

1. Purpose
This Acceptable Use Policy ("AUP") sets out the rules that apply to everyone who uses AvatarMill
(the "Service"), including all members of any workspace. It is part of our Terms of Service.
Breaching it can lead to content removal, workspace suspension, account termination, forfeiture
of credits, and (in serious cases) referral to law enforcement.
If you are the Owner of a workspace you are responsible for ensuring everyone you invite
understands and follows this AUP.
2. Absolute Prohibitions
The following uses of the Service are absolutely prohibited. There are
no creative, satirical, or research exceptions, and breach will result in immediate
termination and, where applicable, reporting to law enforcement.
- Child sexual abuse material (CSAM): any image, video, or prompt that depicts,
sexualises, or attempts to generate a minor in a sexual or sexually-suggestive context.
We use automated and manual review and report suspected CSAM to the National Center for
Missing & Exploited Children (NCMEC) and equivalent authorities.
- Non-consensual intimate imagery: sexual or nude depictions of an identifiable
real person without their explicit, demonstrable, prior consent. This includes "nudify"
use of clothed source photos and undressing or sexualising real people.
- Sexualisation of public figures or strangers: creating sexual or sexually-suggestive
content depicting an identifiable real person you have not obtained consent from, including
public figures, celebrities, influencers, or anyone whose photo you found online.
- Content depicting real-world violence against real people: realistic depictions
of murder, assault, torture, or terrorism targeting identifiable individuals or groups.
- Promoting or facilitating self-harm or suicide.
- Material that incites or promotes terrorism, genocide, or mass violence.
3. Identity, Likeness, and Consent
3.1 Reference Photos
When you upload reference photos of an identifiable real person to create a character,
you represent and warrant that:
- You are that person, or you have that person's explicit, informed, prior consent to
use their likeness with an AI generation service
- You will not use the resulting character to depict that person in contexts they have
not agreed to
- You will honour any request to delete their likeness from the Service
3.2 Public Figures and Strangers
You must not upload reference photos of, or generate content depicting, identifiable
public figures, celebrities, influencers, politicians, or strangers without their
consent. This applies regardless of whether the photos are publicly available online.
3.3 Disclosure of Synthetic Content
When you publish or distribute content generated by the Service that depicts a real
person or could be mistaken for a real-world photograph or recording, you must disclose
that it is AI-generated where required by applicable law (including the EU AI Act and
similar regimes) or by the platform you are publishing on.
4. Misinformation, Fraud, and Manipulation
You must not use the Service to:
- Create content intended to be passed off as a genuine news event, official statement,
or recording of a real event that did not occur
- Impersonate any person or organisation, including by mimicking their public
communications, branding, or voice in misleading ways
- Generate fake evidence, fake documents, fake identification, or fake reviews
- Conduct or facilitate phishing, scam, or social-engineering campaigns
- Manipulate elections or political processes, including generating deceptive depictions
of candidates or officials
About device-authentic metadata: the Service offers device profile and EXIF
finishing intended to make Generated Content suitable for native upload to social platforms
that expect realistic camera metadata. You must not use this feature to deceive a court, regulator,
journalist, insurance company, or other party as to the origin of the content.
5. Intellectual Property
You must not use the Service to:
- Reproduce or imitate the work of identifiable artists, designers, or studios in ways
that infringe their copyright or trademark rights
- Generate content using prompts that name a living artist with the intent of
replicating their style for commercial use
- Reproduce protected logos, branding, or trade dress without authorisation
- Circumvent watermarks, content credentials, or attribution embedded in source material
6. Sexual Content
The Service is not intended for the production of pornography or sexually-explicit
content, and our upstream AI providers prohibit it. You must not use the Service to
generate:
- Pornographic or sexually-explicit imagery of any kind
- Nude or semi-nude depictions of real people without consent (see Section 2)
- Content sexualising minors in any form (absolutely prohibited; see Section 2)
Tasteful, non-sexual depictions of the human body (for example, swimwear, fashion, or
fitness) are permitted subject to the rest of this AUP and the policies of any platform
you publish on.
7. Harassment and Hate
You must not use the Service to:
- Harass, threaten, intimidate, or stalk any person
- Generate content depicting an identifiable person in a degrading or humiliating manner
- Promote violence or hatred against any group based on race, ethnicity, national
origin, religion, gender identity, sexual orientation, disability, or other protected
characteristic
- Use slurs, dehumanising language, or violent imagery targeting protected groups
8. Dangerous, Harmful, and Illegal Activity
You must not use the Service to plan, promote, instruct, or facilitate:
- The manufacture, sale, or use of weapons (including firearms), explosives, biological,
chemical, or radiological agents
- The synthesis or distribution of controlled substances or precursors
- The unauthorised access to, disruption of, or damage to any computer system, network,
or service (including ours)
- The development or deployment of malware, ransomware, spyware, or surveillance tools
targeting individuals without consent
- Any other activity that is illegal in the jurisdiction where you operate or where the
affected person is located
9. Service Integrity
You must not:
- Attempt to bypass, evade, or interfere with rate limits, billing, content moderation,
watermarking, or safety systems
- Probe, scan, or test the vulnerability of the Service except as part of a coordinated
disclosure (contact hello@avatarmill.com first)
- Resell or sublicence access to the Service without our written agreement
- Scrape, crawl, or systematically harvest data from the Service beyond what our APIs
permit
- Use the Service to train competing AI models, derive model weights, or generate large
synthetic datasets for redistribution
- Use multiple accounts to circumvent suspensions, free trials, or rate limits
10. Reporting Violations
If you believe content or activity on the Service violates this AUP, applicable law, or
your rights, please email hello@avatarmill.com with as much
detail as you can provide (URLs or asset IDs, the nature of the violation, and any evidence).
Reports of CSAM, non-consensual intimate imagery, or imminent harm are prioritised.
If you have lost control of a likeness, character, or workspace and need urgent takedown
assistance, mark your email "URGENT — TAKEDOWN".
11. Enforcement
We may, with or without notice and at our sole discretion:
- Remove or restrict access to specific content or characters
- Suspend or terminate the offending user account or entire workspace
- Forfeit any unused credits in a workspace terminated for breach
- Refer the matter to the upstream providers we depend on
- Refer the matter to law enforcement, NCMEC, IWF, or other relevant authorities
- Cooperate fully with lawful investigations, including disclosing account, billing, and
content data
Decisions about enforcement are made by us and are final, but you may appeal a
suspension by contacting hello@avatarmill.com with context.
12. Changes to This Policy
We may revise this AUP from time to time. We will indicate revisions by updating the
"Last updated" date and, for material changes, by sending notice to your account email.
Your continued use of the Service after changes take effect constitutes acceptance of
the revised AUP.
